Walmart Marketplace Retailer Class Action Litigation Information Website

Several terminated Walmart Marketplace Retailers have filed a Class Action Lawsuit against Walmart Inc. in the United States District Court for the Western District of Arkansas. The Plaintiffs allege that Walmart’s withholding of terminated Retailers’ funds violates various aspects of Arkansas law, and that the Walmart Marketplace Retailer Agreement’s provisions which Walmart relies upon for doing so are an illegal penalty and void as a matter of law.

The lawsuit seeks relief on behalf of all Walmart Marketplace Retailers who are parties to Walmart’s Comprehensive Walmart Marketplace Program Retailer Agreement who have had funds withheld by Walmart pursuant to §5 of those Agreements and further seeks the return of funds withheld on this basis. The Court has not yet determined whether or not Plaintiffs can prosecute this litigation on behalf of a Class and has not made any rulings as to the substance of plaintiffs’ allegations in the lawsuit.
